HOW TO ENTER: To enter for a chance to win, participants must visit www.TheBigWelcome.com, successfully enroll for a Hyatt Gold Passport membership or enter a current  Hyatt Gold Passport account number, answer five survey questions, complete the Official Online Entry Form, accept the Official rules, and click “submit.”  Membership is free and without obligation, and is subject to program terms and conditions.  New Member enrollment or current member registration must be between 12:01 a.m. Central Time (“CT”) on April 2, 2009 and 11:59 p.m. CT on May 13, 2009 (“Promotion Period”).  Both current and new Hyatt Gold Passport members are eligible to enter for a chance to win.  Entrants and prize winners may be notified using their Hyatt Gold Passport personal account information (i.e., country/state/province, e-mail address, first and last name), and are solely responsible for keeping such account information up-to-date.  If an entrant’s account information is not complete, correct, or current, (i.e., country/state/province, e-mail address, first and last name are missing, incorrect or not current), such entrant will be automatically disqualified and ineligible to participate in this Sweepstakes.  Limit one (1) entry per Hyatt Gold Passport account number.  Subsequent entries from the same account number will be automatically disqualified from the SweepstakesIf entrant has special needs within the meaning of the Americans with Disabilities Act, and requires assistance in order to participate in the Sweepstakes, call (262) 780-6164.  Hyatt Corporation (“Hyatt”) (“Sponsor”), GMR Marketing LLC (“GMR”), BBDO New York (“BBDO”) and their affiliates, sales representatives, distributors and participating promotion and other vendor agencies involved in this promotion are not responsible for lost, late, or misdirected entries or the operation of the Sweepstakes.

ELIGIBILITY: Participating entrant must be 18 years of age or older or the age of majority in their state/province of residence, and a legal resident of the 50 United States (including the District of Columbia) or Canada (excluding Quebec), and a current or new member of the Hyatt Gold Passport program.  This Sweepstakes is for viewing in the United States and Canada only.  If you do not live in the United States or Canada, do not enter the Sweepstakes.  Void where prohibited by law.  Employees of Hyatt, GMR, BBDO, and their respective agencies, affiliates, sales representatives, and promotion and other vendor agencies involved in this promotion and the immediate family (parents, spouses, siblings, and children) and household members of all such employees, are NOT eligible to enter or win. 

DAILY PRIZES: Each day during the Promotion Period, daily prizes (“daily prizes”) will be awarded.  Each day between April 2, 2009 and May 12, 2009, two hundred and thirty-nine (239) daily prizes will be awarded.  On May 13, 2009, two hundred and one (201) daily prizes will be awarded.  Daily prize winners will be randomly selected each Monday from among all eligible entries received during the previous week during the Promotion Period.  Non-winning entries will carry over into all subsequent daily drawings during the Promotion Period with the exception of entries received on May 13, 2009.  Daily drawings will be conducted in accordance with the Official Rules by GMR, an independent judging organization whose decisions on all matters related to the Sweepstakes are binding and final.  Limit one (1) prize per Hyatt Gold Passport account number.

DAILY PRIZE AND APPROXIMATE RETAIL VALUE:
Ten Thousand (10,000) Daily Prizes (239 daily prizes to be awarded each day between April 2, 2009 and May 12, 2009 and 201 daily prizes to be awarded on May 13, 2009): One (1) Hyatt Gold Passport Free Night award valid through June 30, 2010 at a Hyatt Hotel of winner’s choice.  Prize will be awarded in the form of a free night award applied to the winner’s Hyatt Gold Passport account.  Hyatt Gold Passport award reservation must be made via “My Promotional Awards” on goldpassport.com or by calling 800.228.3360 or your nearest worldwide reservation center.  A credit card guarantee is required at time of booking.  Hyatt Gold Passport award reservations are subject to the reservation requirements of individual hotels, such as length of stay, and are subject to the cancellation policy of the individual property at which member is redeeming award.  If member does not follow proper hotel cancellation policy or if member does not check into the hotel, member will be billed for one night's room and applicable tax at the prevailing rate of the day.  Free Night award is valid for standard guest room accommodations, subject to availability.  Free Night award will be automatically deducted from member's account within 3 days of booking.  The Free Night Award is for room charges only and does not include incidental expenses, gratuities, service charges or other hotel-specific charges.  The Free Night Award is valid for single or double occupancy.  Additional guests are subject to additional hotel charges.  Hyatt Gold Passport awards are not negotiable, commissionable or redeemable for cash and are void if sold for cash or other consideration.  The approximate retail value (ARV) of one free standard night stay is $190 USD.  Sponsor will comply with all tax reporting obligations.  All federal, state, provincial, and local taxes and fees are the sole responsibility of the prize winner.  Prize consists only of items specifically listed as part of the prize.  No substitution or cash equivalent is allowed, except in Sponsor’s sole discretion.  Sponsor reserves the right to substitute prize of the same approximate retail value.  Odds of winning depend on the number of eligible entries received.  The Total ARV of all prizes to be awarded is $1,900,000 USD.

DAILY PRIZE WINNERS: Potential Daily Prize winners will be notified approximately one (1) business day following winner selection by e-mail only to the e-mail address indicated during Hyatt Gold Passport member registration.  If a potential daily prize winner is from Canada, he/she will be required to successfully complete and submit an electronic, mathematical skills test within three (3) business days from the time the e-mail notification was sent by Sponsor before the prize will be awarded.  Failure to successfully answer and submit the skill-testing question in the time specified by the Sponsor will result in the prize being forfeited and an alternate winner selected.  Award of prize and confirmation of winner is contingent upon potential winner’s qualification and compliance with all Official Rules.  Alternate winners, if needed, will be selected in a Second Chance Drawing (see “Second Chance Drawing” Section below).  Daily Prizes will be credited to the prize winner’s Hyatt Gold Passport account approximately four (4) to five (5) business days after winner is confirmed.  Except where prohibited, acceptance of a Daily Prize constitutes winner’s consent that their name, likeness, voice, and/or biographical data may be used in any medium for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.

SECOND CHANCE DRAWING: Any Daily Prizes not awarded during the Promotion Period will be awarded in a Second Chance Drawing from among all non-winning eligible entries received during the Promotion Period.  The Daily Prize Second Chance Drawing will be held on or about May 18, 2009, and second chance winners will be notified via email only approximately one (1) business day following the drawing.  Drawing will be conducted by GMR, whose decisions are final and binding in all matters relating to the drawing.  Odds of winning a prize in the Second Chance Drawing depend on the total number of eligible entries received and the total number of unawarded Daily Prizes.

ONLINE REGISTRATION: If for any reason the Sweepstakes, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor or GMR deems responsible and Sponsor further reserves the right to cancel, terminate, modify or suspend the Sweepstakes, with appropriate alternate method of prize award selected.  Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize.  Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.  WARNING:  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  Sweepstakes entries generated by a script, macro, or other mechanical or automated means are ineligible and will be disqualified.  All entries must include a valid e-mail address for the entrant.  In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry.  The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.

ADDITIONAL TERMS: By entering, entrant agrees to accept and abide by the rules of this Sweepstakes and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation or award of prize, shall be resolved by GMR, whose decision shall be binding and final.  By participating, entrant agrees to release and hold harmless Hyatt, GMR, BBDO, and each of their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations from any injury, loss or damage to person, including death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize, participation in any Sweepstakes-related activity, or participation in the Sweepstakes.  Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes or in the announcement of prizes, including such error as may give an erroneous indication that a prize has been won.  In the event the Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event), the Sponsor shall have the right, in its  sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation.  If the Sponsor, in its discretion, elects to abbreviate the Sweepstakes as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event.  All entries are the property of the Sponsor and are not returnable.

Once enrolled as a Hyatt Gold Passport member, (including creation of a “user name” and “password”), you will be required to complete the Official Online Entry Form found at www.TheBigWelcome.com, and complete and submit your essay based on the instructions provided during the entry process. You will also be required to complete a short online travel-related survey. The online promotion starts at 12:01 a.m. Central Time (“CT”) on April 2, 2009 and ends at 11:59 p.m. CT on May 13, 2009. All online entries must be submitted by 11:59 p.m. CT on May 13, 2009. In the event of a dispute regarding the identity or eligibility of the potential Grand Prize winner based on the email address or the Gold Passport account, the winning entry will be declared made by the “Authorized Account Holder” of the email address or Gold Passport account number submitted at the time of entry (see “Winners” section for further information). JUDGING CRITERIA/WINNER SELECTION: This is not a game of chance.  Winners will be chosen based on the quality of a written entry of 250 words or fewer (and optional accompanying photo, original drawing, video or audio file) to the following question: “How would you spend 365 free nights at Hyatt to create an unforgettable experience?”  If the essay surpasses 250 words only the first 250 words will be judged. On or about May 14, 2009, entries will be judged on a 100-point scale as follows:  40 points for originality; 40 points for creativity; 10 points for incorporation of Hyatt brand attributes; and 10 points for organization/clarity and grammar. Entrants may earn up to five Bonus Points for submitting a photo, original drawing, video or audio file that embellishes their essay. All entries will be judged by Hyatt’s agency personnel in a Preliminary Round on or about May 14, 2009, and up to 20 entries will advance to the Semi-Finals Round. In the Semi-Finals Round, visitors to www.TheBigWelcome.com will select the Top Five entries through online voting from 12:01 a.m. CT on May 26, 2009 through 11:59 p.m. CT on June 2, 2009. LIMIT ONE (1) VOTE PER HYATT GOLD PASSPORT ACCOUNT NUMBER PER DAY. Based on vote totals, the Top Five will then be judged in a Finals Round on or about June 4, 2009 by a second judging panel consisting of Hyatt and agency personnel, using the same criteria as the Preliminary Round. The Grand Prize winner will be announced on www.TheBigWelcome.com on or about June 12, 2009. In the event of a tie at any level – Preliminary, Semi-Finals or Finals rounds – the entries involved will be re-judged by an additional judge designated by the Sponsor, who will select a winner that best reflects all criteria as a whole. Any entry will be eliminated, regardless of point total, (i) if it is not consistent with Sponsor’s reputation in the marketplace, including its reputation for quality and integrity, (ii) if it does not reflect the goals of the promotion, (iii) if the language of the entry is not suitable for all ages, (iv) or if the entry is so deficient in grammar, spelling, sentence structure or content as to be unclear or inappropriate. Accounts of illegal uses will be not be eligible. Essays (and photos, original drawings, videos or audio files) must be the entrant’s original creation. Previously published essays that have won any other award will be disqualified. Entry cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights. Do not use music or other protected material in submitted materials, and do not depict any logos or trademarks, etc (except Hyatt marks). Entries should be completed electronically in the online essay section of the contest. All entries become the property of Sponsor and Sponsor shall hold all copyright, ownership, title and right thereto.  An entrant’s submission of an entry constitutes permission for Sponsor to use the entrant’s name, answers and other material provided in the entry for any purpose, including for promotional purposes in any media without compensation. As a condition of acceptance of prize, which shall constitute full and sufficient consideration, potential final winners must grant an unrestricted copyright license of the winning entry, audio, sound bites, photographs, original drawings and video to Sponsor, or an alternate winner will be chosen. Electronic entries will serve as an initial selection tool and for verification of entrant information and eligibility. Sponsor and GMR reserve the right, in their sole discretion, to choose alternate winners if information contained in the entry cannot be verified to the satisfaction of Sponsor.

PRIZE AND APPROXIMATE RETAIL VALUE: One (1) Grand Prize: 365 Hyatt Gold Passport Free Night awards valid through June 30, 2014 at Hyatt Hotels worldwide of winner’s choice and 1 million frequent flyer airline miles to be applied to a   Gold Passport travel partner program of winner’s choice, subject to the terms and conditions of the selected program. A representative designated by Hyatt will be specially-assigned to the winner for assistance with booking the Hyatt Gold Passport Free Night awards throughout the validity of the awards.  Although the winner will have such assistance, Hyatt Gold Passport Free Night awards will be subject to availability and the reservation requirements of the individual property, such as length of stay and other restrictions. A credit card guarantee is required at time of booking. Hyatt Gold Passport Free Night awards are subject to the cancellation policy of the individual property at which the award is redeemed.  Hyatt Gold Passport Free Night Awards are valid for Standard Guest Rooms. Hyatt Gold Passport Free Night awards are not negotiable, commissionable or redeemable for cash and are void if sold for cash or other considerations. Hyatt Gold Passport awards will be deducted from the member’s account within 3 days of award booking. 1 million miles will be credited to the Grand Prize winner’s frequent flyer program of choice. The frequent flyer program must be selected by the winner from among Hyatt’s participating airline travel partners. A list of the partners will be disclosed to the winner upon confirmation of prize eligibility. If the Grand Prize winner is not already a member of the selected frequent flyer program, he/she will be required to enroll in the program. Air travel is subject to the terms and conditions of the selected frequent flyer program, and is subject to blackout dates and other such restrictions.  Grand Prize winner will be responsible for booking rooms directly with the designated Hyatt customer service representative and booking flights through redemption of frequent flyer points directly on the selected program.  Frequent flyer miles will be deducted from winner’s account as they are used. Unused and/or expired frequent flyer miles may not be redeemed for cash and/or for other services or merchandise. 

In addition to the Grand Prize outlined above, the confirmed winner (U.S. only; does not apply to a potential Canadian winner) will also receive a single cash payment in the form of a corporate check intended to assist with any federal, state or other tax obligations related to the prize (the “Tax Gross-Up Payment”) as well as to cover any service fees, surcharges or other taxes or fees associated with redeeming frequent flyer miles.. The amount of the Tax Gross-Up Payment will be computed based on the actual retail value of the Grand Prize and assuming winner’s combined tax rate for all federal, state and other tax obligations related to the Grand Prize is 34%, but in no event will the Tax Gross-Up exceed $50,000. The Tax Gross-Up Payment may not be sufficient to cover winner’s entire tax liability related to accepting the Grand Prize. Winner is responsible for the payment of taxes to the relevant taxing authorities for all federal, state and local income taxes and any other taxes associated with the Grand Prize and the related Tax Gross-Up Payment. Sponsor and GMR will comply with all tax-reporting requirements.

The approximate retail value (ARV) of one free standard-night stay at a Hyatt hotel is $190 USD. The total ARV of 365 nights is $69,350 and the ARV of 1 million frequent flyer miles is $25,000. The ARV for the Grand Prize package is $94,350 USD. The ARV does not include value of the Tax Gross-Up Payment, which based on the total grand prize ARV of $94,350 is estimated to be $144,350 combined. The final ARV may fluctuate based on the value of the 1 million airline miles for the selected frequent flyer program, and will not exceed $25,000. A form 1099 will be sent to the IRS (with a copy to the winner-U.S. winner only; does not pertain to potential Canadian winner) to report the combined value of the Grand Prize, Tax Gross-Up Payment and Service Fees Payment, all of which is to be included in the Grand Prize winner’s taxable income.

Sponsor will comply with all tax reporting obligations. No prize will be awarded to a potential winner who fails to meet all criteria, and an alternate winner will be chosen. No substitution or transfer of prize is allowed except that the Sponsor reserves the right to substitute prizes of the same approximate retail value.  Prize consists only of items specifically listed as part of the prize. Certain conditions and restrictions may apply. No cash or other substitutions will be allowed except as expressly allowed under the terms and conditions of the Hyatt Gold Passport or selected airlines frequent flyer programs.

WINNERS: Up to 20 Preliminary Round Winners will be notified by phone and/or express mail on or about May 15, 2009, and will be required to execute a Publicity Release as a condition of advancing to the Semi-Finals and/or Finals. Winner documents must be returned by May 22, 2009 to be eligible to advance to the Semi-Final voting round. Failure to meet this deadline will result in forfeiture of the prize, and time permitting, an alternate will be selected. Potential Grand Prize winner will be notified by a phone call and/or express mail to the address listed on the entry form or his/her Hyatt Gold Passport account. Potential Grand Prize winner may make no substitution.  Potential Grand Prize winner must execute an Affidavit of Eligibility, mutually-acceptable Liability and Publicity Releases, Assignment of Rights and copyright assignment within seven (7) calendar days of notification or the prize will be forfeited in its entirety and an alternate winner may be chosen. Potential Grand Prize winner may also be subject to a Criminal Background Check, and Sponsor reserves the right to disqualify potential winner based on the results of the background check. The identity or eligibility of a selected potential Grand Prize Winner will be based on an email address and the winning entry will be declared made by the “Authorized Account Holder” of the email address or Hyatt Gold Passport account number submitted at the time of entry.  The “Authorized Account Holder” is defined as the natural person who is assigned to an email or wireless address by an Internet access or wireless provider or has permission of the assignee to use the account. Documentation may be required to prove identity and/or eligibility. Any necessary alternate winner will be selected in a similar fashion as the original process.

ONLINE ENTRY: This contest is intended for viewing in the United States and Canada (excluding Quebec) and is governed by applicable United States law. If you are not a legal resident of the U.S. or Canada, you are not eligible and may not participate in this promotion.  If for any reason the online portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the contest at any time. Each entry must be manually key-stroked and manually entered by the participant.  Repetitive automated electronic submission of entries is prohibited, and any such entries will be disqualified. GENERAL RULES: Entrants agree to accept and abide by the rules of this contest and agree that any dispute with regard to the conduct of the contest, rule interpretation or award of prizes, shall be submitted to GMR, whose decisions shall be binding and final.  By participating, entrant agrees to release and hold harmless Sponsor, GMR, BBDO,  and their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, investors, agents and representatives of any of the above organizations from any injury, loss or damage to person, including death or property, due in-whole or in-part, directly or indirectly, due to the acceptance from or use/misuse of a prize or participation in any promotion-related activity. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the contest or in the announcement of prizes. In the event Sponsor is prevented from continuing with this promotion, or the integrity and/or feasibility of the promotion is severely undermined by any event beyond Sponsor’s control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the promotion without  further obligation.  If Sponsor, in its discretion, elects to abbreviate or cancel the promotion as a result of a Force Majeure event, Sponsor reserves the right, but not the obligation, to award the prize from among all eligible entries received up to the date of such Force Majeure event.  All entries belong to Sponsor and are not returnable.
